Work Permits Tier 2 - [GENERAL RULES FOR MIGRANTS]

 

General rules applicable to all applicants wanting to travel to the UK under Tier 2

       An applicant qualifying for entry under Tier 2 may still be refused on other grounds (such as previous immigration history)

       All supporting documents must be originals rather than copies

       Any document which is not in English or Welsh must be accompanied by a fully certified translation by a professional translator

       Any incomplete application or an application which does not include the required documents will be refused

       Entry clearance must be arranged prior to arrival in the UK

       Application for entry clearance must be accompanied by a valid Certificate of Sponsorship reference number

       Entry to the UK is permitted up to 14 days before the employment start date recorded on the Certificate of Sponsorship

       The applicant must be a minimum of 16 years old at the time the application is decided

       If the Sponsor is a limited company then the applicant must not own more than 10% of its shares

       The applicant is not allowed any recourse to public funds whilst in the UK

       The applicant must register with the UK Police if this is required (Generally this only applies to nationals of certain countries)

       The applicant must work for his or her sponsor in the job detailed on the Certificate of Sponsorship

       The applicant may take supplementary work and engage in voluntary work

Tier 1 Visa (General) Overview

 As part of the UK's five-tier points based immigration system, Tier 1 (General) allows highly skilled individuals who score the requisite points to immigrate to the UK without any kind of sponsorship from an employer. Highly skilled individuals include doctors, scientists, engineers, MBAs, and other educated workers. If you can speak English, have earned at least the equivalent of a bachelors degree, and can show that you have earned a relatively good income in your home country, Tier 1 (General) is the right scheme for you.

Since 2002, the UK has been actively encouraging skilled migrants to immigrate to the country -- first through the HSMP and now through its Tier 1 (General) visa for general highly skilled migrants, which replaced the Highly Skilled Migrant Programme (HSMP) on 30 June 2008.

Tier 1 (General) is very similar to the previous HSMP, save for the notable exception of the removal of the MBA provision which allowed those with MBAs from a list of specific universities to claim an automatic 75 points. English language requirements are also more stringent. Business/entrepreneur  visa  - please replace section  4 of  visas

The Entrepreneur sub-category is a merging of the previous Businesspersons and Innovators schemes. The Entrepreneur sub-category is perfect for those individuals wishing to start a business in the UK who can meet the criteria.

Specific Criteria

A pass mark of 75 points are needed to satisfy the requirements for the specific criteria under the Entreprenuer sub-category.

Applicant has at least £200,000

Funds are held in a regulated financial institution

Funds are disposable in the United Kingdom

English Language Ability

Applicants must show that they are proficient in English by proving one of the following:

       They have passed a test in English equivalent to level C1 of the Council of Europe's Common European Framework for Language Learning (equivalent to a grade C or better at GCSE)

       Come from a country where English is the majority language spoken

       Have taken a degree taught in English (this is verified by using the National Academic Recognition Information Centre data)

Successful proof of one of these criteria will earn the required 10 points for the English language requirement.

Maintenance

Applicants from outside the country will be required to score ten points by proving they can support themselves and any dependants.

2/3 of the £2,400 is required for first dependent of the main applicant, and 1/3 for each subsequent dependant.

Investors

Under the United Kingdom's new five-tier points based immigration system, people can immigrate to the UK through investment under the Tier 1 (Investor) subcategory of the first tier. See below for detail on how visas are granted for those wishing to come to the UK under this part of Tier 1.

Specific Criteria

A pass mark of 75 points is needed to satisfy the requirements for the specific criteria under the Investors sub-category.

Applicants have at least £1,000,000 of their own money in a regulated financial institution in the UK, or

A) Own personal assets which exceed £2,000,000 in value, provided they are not subject to any liabilities; and
B) Have money under their control held in a regulated financial institution and disposable in the UK of at least £1,000,000, which may include money loaned to them provided it was loaned by a financial institution regulated by the Financial Services Authority

English Language Ability

Because potential migrants applying under the Investor sub-category are not expected to need to work, the English language requirement is waived.

Maintenance

By definition, potential migrants applying under the Investor category are extremely wealthy and do not need to prove an ability to support themselves and their dependants. Therefore, this requirement has been waived for the Investor sub-category.
